ICE Warrants vs Judicial Warrants

If Immigration and Customs Enforcement (ICE) is knocking at your door it is important that you remain calm and ask to see a warrant. Do not open the door. Ask the ICE agent to slide the warrant under the door or show you the warrant at a window. Check the letterhead of the warrant to verify it is from a Court and check the signature line to see if it is signed by a Judge. If is not from a Court and not signed by a Judge the warrant presented is not a Judicial warrant and you are protected from unreasonable searches and seizures by the fourth amendment. ICE will not be able to enter your home because it is a private, non-public area and that requires a Judicial Warrant. ICE agents use disguises and deceptive tactics to get around the limitations of the law. These same protections are available at the non-public, private areas in your workplace. A lunch room, for example, would be considered a private, non-public area if it is for Employees only. Here is an example of an ICE warrant and a Judicial Warrant.
